1. Personal Data

HALO Hahn Loidolt RechtsanwältInnen OG, Hoher Markt 8-9/2/10, 1010 Vienna, and its employees and lawyers (substitute lawyers) as well as trainee lawyers collect, process and use your personal data only with your consent and/or authorization or instruction for the agreed purposes or if another legal basis exists in accordance with the GDPR. This is done in compliance with data protection and civil law provisions.

Only such personal data is collected as is necessary for the performance and processing of legal services or which has been voluntarily provided to us.

Personal data means all data containing individual information about personal or factual circumstances, such as name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photographs, voice recordings of persons, as well as biometric data such as fingerprints. Sensitive data, such as health data or data relating to proceedings before a court and/or an authority, may also be included.

2. Right of Access, Deletion and Other Rights of Data Subjects

Clients and/or data subjects have – subject to the obligation of lawyers to maintain professional confidentiality – the right at any time to obtain information about their stored personal data, its origin and recipients and the purpose of data processing, as well as the right to rectification, data portability, objection, restriction of processing, and blocking or deletion of incorrect and/or unlawfully processed data.

If there are any changes to personal data, HALO Hahn Loidolt RechtsanwältInnen OG requests that you notify us accordingly.

You have the right at any time to withdraw consent that has been given for the use of your personal data. Your request for withdrawal, access, deletion, rectification, restriction, objection and/or data portability, in the latter case insofar as this does not cause disproportionate effort, may be sent to the address of our law firm stated under Section 9 of this declaration. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.

4. Use of Data

HALO Hahn Loidolt RechtsanwältInnen OG and its employees and lawyers (substitute lawyers) as well as trainee lawyers will not process the data provided by you for purposes other than those covered by the mandate agreement, your consent or otherwise by a provision in accordance with the GDPR. This does not apply to use for statistical purposes, provided that the data provided has been anonymized.

5. Transfer of Data to Third Parties

In order to fulfill your instructions, it may also be necessary to forward your data to third parties (e.g. opposing parties, substitute lawyers, insurance companies, notaries, service providers used by HALO Hahn Loidolt RechtsanwältInnen OG and to whom data is provided, etc.), courts or authorities, as well as the Bar Association. Data is transferred exclusively on the basis of the GDPR and/or the Data Protection Act, in particular for the fulfillment of the assignment or on the basis of prior consent. The level of data protection in other countries may not correspond to that in Austria. However, HALO Hahn Loidolt RechtsanwältInnen OG and its employees and lawyers (substitute lawyers) as well as trainee lawyers only transfer personal data to countries for which the European Commission has determined that they have an adequate level of data protection, or HALO Hahn Loidolt RechtsanwältInnen OG and its employees and lawyers (substitute lawyers) as well as trainee lawyers take measures to ensure that all recipients have an adequate level of data protection, including the conclusion of standard contractual clauses (2010/87/EC and/or 2004/915/EC).

6. Notification of Data Breaches

HALO Hahn Loidolt RechtsanwältInnen OG and its employees and lawyers (substitute lawyers) as well as trainee lawyers endeavor to ensure that data breaches are detected at an early stage and, where applicable, reported without delay to you and/or the competent supervisory authority, including the respective categories of data affected.

7. Retention of Data

Data is not retained for longer than is necessary to fulfill our contractual and/or statutory obligations and to defend against any pending or specifically threatened legal disputes. Where retention periods under commercial and tax law must be observed, certain data may be stored for up to seven years. In order to fulfill record-keeping obligations with regard to the prevention of money laundering and terrorist financing, the retention period may be up to ten years. Professional obligations and the limitation period for legal claims (depending on the legal basis, up to 40 years) must also be observed.

8. Google Analytics

Our website uses functions of the web analytics service “Google Analytics”, which is provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA).

Cookies are used for this purpose, which enable an analysis of the use of the website by its users. The information generated in this way is transferred to the provider’s server and stored there.

Within the framework of the data processing agreement that we, as the website operator, have concluded with Google Inc., Google uses the information collected to evaluate website usage and website activity and provides services associated with Internet usage.

Our objective within the meaning of the GDPR (legitimate interest) is to improve our services and our web presence. Since the privacy of our users is important to us, user data is pseudonymized. No personal data is processed when the website is merely visited.
